Hey there you probably want to return that copy as soon as possible. Gamestop must of overlooked that copy and you are entitled to a working copy!
Yes it is , but if you happen to have a working battery I highly recomend you to have six pokémon in your party to increas your chance to acounter it but don't think it will automaticaly find it because Mirage Island is eaven more rare then acountering a Wild Shiny pokémon .

I think it depends on the previous owner, GameStop just sells the games as people bring them in, apart from an authenticity check they don’t even delete the previous save data. I bought both LeafGreen and Emerald from GameStop used but only leaf green had a fresh internal battery.
