SWEEPSTAKES OPEN TO LEGAL RESIDENTS OF THE UNITED STATES (EXCLUDING GUAM AND PUERTO RICO), AND THE DISTRICT OF COLUMBIA, WHO ARE AT LEAST 18 YEARS OF AGE AT TIME OF ENTRY AND CURRENTLY LIVING IN THE UNITED STATES. VOID IN GUAM, PUERTO RICO AND WHERE PROHIBITED BY LAW.

Term: Ultimate Guitar Hero Sweepstakes (“Sweepstakes”) begins on September 8, 2008 at 9:00 a.m. and ends on October 10, 2008 at 5:00 p.m. CDT. (Term)
Eligibility: Sweepstakes is open to all legal residents of the United States, including the District of Columbia, who are at least 18 years of age at the time of entry and currently living in the United States. Void in Guam, Puerto Rico and where prohibited by law. Employees of GameStop Inc., and affiliated companies and members of the immediate families are not eligible. Sweepstakes is subject to all local, state and federal laws and regulations. By entering this sweepstakes, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations.
How to Enter: (A) On-line Entry. During sweepstakes period, go to www.GameStop.com/UltimateGuitarHero and follow the instructions on how to enter the sweepstakes. All entries must be received starting at 9:00 a.m. on September 8, 2008 and ending on October 10, 2008 at 5:00 p.m. CDT (“Sweepstakes Entry Period”). Limit: one online entry per person per Sweepstakes Entry Period. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. By entering, participants acknowledge compliance with the Official Rules, including eligibility requirements and agree to be bound by these Official Rules and the decisions of the Sponsor and independent judging organization, which shall be final and binding. The use of any device to automate the entry process is prohibited. Illegible or mechanically reproduced entries are not eligible. All entries and requests become the Sponsor’s property and will not be returned or acknowledged. The Sponsor is not responsible for lost, late, damaged, incomplete or misdirected entries.
(B) Alternate Method of Entry: Mail-in Entry. Please fill out the downloadable entry form available at www.gamestop.com/ultimateguitarhero and mail to 954 3rd Avenue #641, New York, NY 10022. Limit one entry per household. All entries and requests become the Sponsor’s property and will not be returned or acknowledged. Illegible entries are void. The Sponsor is not responsible for lost, late, damaged, incomplete, misdirected, mutilated, postage due, or entries not received in time for drawing. All entries must be post marked no later than October 10, 2008 and received no later than October 14, 2008.
Prizes: Sponsor will award one (1) Grand Prize per each of the three categories. The “Families Who Rock” category will receive (1) Six free passes to Six Flags Theme Parks, (1) $500 gas card, and (1) copy of Guitar Hero World Tour-Band Kit. The “Moms with Star Power” category will receive (1) $1,000 gift card to Elizabeth Arden Red Door Spas and (1) copy of Guitar Hero World Tour-Band Kit. The “Guitar gods” category will receive (1) $200 annual subscription for guitar lessons from GuitarSchool.net, (1) $800 gift card to GuitarCenter.com, and (1) copy of Guitar Hero World Tour-Band Kit. Four (4) first prize winners will receive (1) copy of Guitar Hero World Tour-Band Kit and (1) $50 gift card to GameStop. In addition, there will also be two (2) general entry winners that will receive (1) copy of Guitar Hero World Tour-Band Kit. The total Approximate Retail Value (ARV) of all prizing is $4,910. There is no cash substitute and prizes cannot be redeemed for cash. No more than the stated number of prizes will be awarded.
Winner Selection: Potential winner(s) will be selected on or about October 15, 2008 from among all eligible entries received throughout the Term. The sweepstakes will be conducted by the Sponsor. Potential winners will be contacted by phone at the phone number provided with the entry. If, after reasonable attempts to determine or contact the winner, the potential winner does not respond within seven (7) calendar days of such notification, the entire prize will be forfeited and Sponsor will award the applicable prize to an alternate winner by random choice from among all remaining eligible entries. Grand Prize winners will be required to complete, execute and return an affidavit of eligibility, a liability release and a publicity release (where legal) within seven (7) calendar days of date of prize notification. In the event of non-compliance with this requirement or if prize notification, the Sponsor will award the prize to an alternate winner by random choice from among all remaining eligible entries. There will be three (3) alternates after which the prize will remain unawarded. Prizes are fulfilled 8-10 weeks after the conclusion of the Promotion. All decisions of Sponsor are final. Sponsor reserves the right in its absolute and sole discretion to substitute any prize of equal or greater value.
Prize Restrictions: Limit one (1) prize per individual/household. Prizes are non-transferable, and no substitutions are allowed except by Sponsor, who reserves the right to award a prize of equal or greater value, should the prize become unavailable for any reason. Taxes and any costs associated with the receipt of the prize are the responsibility of the winner. By accepting any prize, winners consent to use of his/her name or likeness for advertising/publicity purposes without further consideration, except where prohibited by law.
Privacy: Any information collected will be subject to Sponsor’s Privacy Policy, located at http://www.gamestop.com/gs/help/PrivacyPolicy.asp. (The “Policy”). By entering the sweepstakes, you acknowledge that you have agreed to the Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this sweepstakes in accordance with the Policy. If you wish to access or correct your personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions respecting our privacy policy, please contact us at help@gamestop.com.
Conduct: By participating, entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the sweepstakes. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any Sponsor web site; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
Release and Limitation of Liability. By entering, participants release and hold harmless Sponsor, respective parent, subsidiaries, affiliates, directors, officers, employees and related entities (collectively, “Releasees”) from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of the prize from or arising out of participation in this sweepstakes. Sponsor assumes no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; (2) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the sweepstakes; (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes; (4) technical or human error which may occur in the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the sweepstakes or receipt or use or misuse of any prize.
Internet: If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, the Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and/or to cancel, terminate, modify or suspend the sweepstakes.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Entry can only be made via one (1) e-mail address per person. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
Disputes: Except where prohibited or otherwise outlined in these Official Rules, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules (whether of the state of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
