HALO PSA CONTEST OFFICIAL RULES
- The "Halo PSA Contest" presented by GameStop, Inc. (the "Contest") begins at 6:00 p.m. Central Time ("CT") September 22, 2009 and ends 11:59 p.m. CT on November 3, 2009 ("Contest Period"). Online access via Contest website is required for detailed information, instructions and entry.
- Eligibility: Contest is offered only in the United States to Legal Residents of the 50 United States (including the District of Columbia), who are at least 18 years old at the time of entry and have Internet access. Employees of GameStop, Inc., ("Sponsor"), its affiliated and subsidiary companies, advertising and promotional agencies, Webmasters and Web suppliers and the immediate family (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors (whether or not related) (collectively, the "Releasees") are not eligible to enter or win a prize. By entering, you agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Winners will be required to complete an Affidavit of Eligibility.
- To Enter: Go to http://www.gamestop.com/halo (the "Web Site") to review Contest rules, and guidelines, register for the Contest and read information on how to enter the contest.
- Participation:
- Limit one (1) person (author) per entry. Multiple entries are permitted, but each must be submitted entirely separate from any other entry.
- Contestants must be at least 18 years old at the time of entry.
- All personal customer data will be uploaded to GameStop.com. After customer data is entered, all videos and related descriptions: will be uploaded directly to Gamestop.com as part of the entry process; will become the exclusive property of GameStop; and, will not be returned.
- All entries (submissions) must be submitted via entry on the Web Site between 6:00 p.m. Central Time ("CT") September 22, 2009 and 11:59 p.m. CT on November 3, 2009 ("Entry Period"). Submissions must incorporate the following guidelines:
Submit a script for a Halo themed Public Service Announcement in writing (maximum 8,000 character length) which incorporates some element of Halo 3 game play.
- Entries received via the Web Site after 11:59 p.m. Central Time on November 3, 2009 will be deemed ineligible for participation in the Contest. Any attempt at entry except as above stated is void.
- By submitting an Entry: (a) you represent and warrant that your Entry is wholly original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) you agree that your Entry shall be a "work made for hire." Notwithstanding this subsection 4f, entries may contain content, game play and music from Halo 3 for Xbox 360 computer entertainment system.
- Microsoft Corporation is the owner of all Halo assets, including, but not limited to, music and video, from the game, Halo 3. Microsoft grants entrants of this contest a limited license to download these for the sole purpose of creating a script for a Machinima video for submission in this contest.
- All entries become the property of GameStop Inc. (“GameStop”) and, as such, can be used in any manner deemed fit by GameStop and will not be returned. By submitting an entry you irrevocably assign to GameStop all right, title and interest in your entry, photo and audio and/or video with the right to make any and all uses thereof throughout the world in perpetuity, including, without limitation, for purposes of advertising, marketing, promotional and other purposes as determined by GameStop and its designees in any and all media whether now known or hereafter devised without further approval or compensation. The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the Contest, including those submitted by non-winners and winners.
- Sponsor assumes no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions. Sponsor reserves the right, at their sole discretion, to cancel, terminate or suspend the Contest should any unauthorized intervention or other cause beyond the control of the Sponsor affect the administration or conduct of the Contest.
- Judging Criteria: One individual Grand Prize Winner will be chosen by Rooster Teeth Productions, via a voting/rating system between November 3, 2009 and December 1, 2009, out of a finalist list of entries. Finalist list will be determined by the Sponsor based on the suitability of the contestant’s entry at the sole and exclusive discretion of the Sponsor. All decisions by the Sponsor are final.
- Prizing: ONE (1) GRAND PRIZE: The Grand Prize consists of having your script turned into a machinima video by RoosterTeeth Productions and released online via GameStop.com. Approximate retail value of Grand Prize (APR) is $4,950.00.
For all prizes, Sponsor reserves the right to substitute prize of equal or greater value. This Contest is governed by U.S. law and is subject to all federal, state, and local laws and regulations. Void in Puerto Rico, Rhode Island, New York, Florida and wherever prohibited by law. Any and all other costs, fees, taxes and expenses not explicitly stated herein as being awarded, are the sole responsibility of the prize recipient.
- Winners: The selected potential winners will be notified by email or telephone within 30 days of the close of the Contest Period. The potential winners will have forty-eight (48) hours from the moment such notification is issued to respond to such notification by following the instructions provided therein. If a potential winner timely responds to such notification, he/she may then be sent an affidavit of eligibility, an image/media release and a liability/publicity release by email, and must complete, sign and return all required documentation within forty-eight (48) hours of issuance. If the potential winner does not reply to the notification within forty-eight (48) hours of its issuance or does not return the signed documents within forty-eight (48) hours of their issuance (if applicable), he/she is ineligible, or he/she cannot or does not comply with these official rules, he/she will be disqualified, the prize will be forfeited, and an alternate winner may be selected, at Sponsor’s discretion. In the event of noncompliance with either the rules or any of these time periods, an alternate winner will be selected. By entering this Contest and/or accepting the prize, all entrants consent to the use of their names, voices, pictures or other likeness for advertising, promotional and other purposes as determined by Sponsor and its designees without further approval or compensation (including on Sponsor’s web sites). Sponsor has the right to revise dates and procedures stated in these rules.
- General: All participants, by entering, agree to release and hold harmless Sponsor, GameStop and Releasees from and against any and all liability for injuries and/or damages sustained in connection with this Contest. All decisions of the Sponsor on all matters relating to this Contest are final. Prize cannot be exchanged, redeemed for cash or transferred and there are no substitutions. If, for reasons beyond the Sponsor’s control, the Contest is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Contest. Sponsor will not be responsible for lost, late, misdirected, damaged, or postage due mail, or for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. IN NO EVENT WILL THE SPONSOR, GAMESTOP OR RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE http://www.gamestop.com OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE
- Cheating: Participants agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest. CAUTION: ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. This Contest and these Official Rules are governed, construed and interpreted under the laws of the state of Texas and any or all claims pursuant to these shall be brought in the courts of the state of Texas. Any provision of these rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these rules will remain in effect.
